Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Hitmania Games Oyun ve Pazarlama Anonim Şirketi, Istanbul, Türkiye (“Hitmania Games”, “we”, “us”). They apply to all mobile games we publish and their related services (the “Games”). By downloading or playing a Game you agree to these Terms. If you do not agree, please do not use the Games.

Some sections, such as those about ads or in-app purchases, only apply to Games that have those features. A Game’s store page and the Game itself show which features it includes.

1. Eligibility

You must be old enough to accept these Terms where you live. If you are under the age of majority (usually 18), a parent or legal guardian must review and accept these Terms for you. Parents and guardians are responsible for how minors in their care use the Games, including any purchases.

2. Licence

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and play the Games on devices you own or control, for your own non-commercial entertainment. This licence also follows the usage rules of the App Store or Google Play, depending on where you got the Game.

You may not copy, modify, translate or create derivative works of the Games; sell, rent, lend, distribute or sublicense them; reverse engineer or decompile them, except where the law allows it; or get around their technical protections. All rights not expressly granted to you are reserved by Hitmania Games and its licensors.

3. Fair play

When you play, you agree not to:

• use cheats, bots, mods, hacks or other unauthorised software that interacts with the Games;
• exploit bugs or glitches to gain an unfair advantage;
• access parts of the Games or our systems that you are not authorised to use, or overload or disrupt them;
• commit fraud, including purchase fraud, chargeback abuse, or fake ad impressions or clicks;
• use the Games for any unlawful purpose.

If you break these rules, we may suspend or end your access to the Games.

4. Virtual items and in-app purchases

Some Games may offer virtual items, such as coins, boosters, lives or ad-free options (“Virtual Items”), which you can earn by playing or buy with real money.

• Virtual Items are licensed to you, not sold. They have no monetary value and cannot be exchanged for real money, or transferred or sold outside the Game.
• We may change, rebalance or remove Virtual Items as part of running the Games. If a paid item stops working because of our fault, contact us and we will try to restore it or offer a fair alternative.
• Progress and items may be lost if you uninstall a Game, change devices or reset your device, unless the Game offers a way to restore them.

Payments and refunds

All purchases are processed by the App Store or Google Play under their own terms, and we never receive your payment details. Refunds are handled by the store you bought from, under its refund policy, so please contact that store to ask for one.

Your consumer rights

Nothing in these Terms limits the rights you have as a consumer under mandatory law, including Türkiye’s Consumer Protection Law No. 6502 and the consumer laws of the EU, the UK and your country of residence.

If you are a consumer in the EU or the UK, you normally have 14 days to withdraw from a purchase of digital content. When you buy a Virtual Item and ask for it to be delivered straight away, you agree that delivery begins immediately and you acknowledge that you lose this right once it has begun. In Türkiye, under the Distance Contracts Regulation, the right of withdrawal does not apply to digital content delivered immediately.

5. Advertising

Some of our Games may show ads from third-party networks, such as banner, interstitial and rewarded video ads. In those Games:

• ads are part of the Game, and their number, frequency, type and placement may change at any time;
• rewarded ads are always optional, and you choose whether to watch one for an in-game reward;
• you may not block, hide or interfere with ads, or create fake impressions or clicks;
• we are not responsible for the content of third-party ads or for the products, services or websites they promote, and any dealings with advertisers are between you and them.

6. Privacy

Our Privacy Policy explains what information we collect when you play, how ads use it and how you can opt out of personalised ads. Please read it together with these Terms.

7. Feedback

If you send us ideas or suggestions about the Games, you allow us to use them freely, without payment or any other obligation to you, to improve the Games or for any other purpose.

8. Intellectual property

The Games and all related content, including code, graphics, levels, characters, music, sounds, trademarks and the Hitmania Games name and logo, belong to Hitmania Games or its licensors and are protected by intellectual property laws. Except for the licence in section 2, these Terms give you no rights to them.

9. Third-party services

The Games rely on third-party platforms and services, such as the App Store, Google Play, analytics and marketing tools, and advertising networks. Their own terms and privacy policies apply to them, and we are not responsible for their content or practices.

10. Updates and availability

We may update the Games, add or remove features and content, retire older versions or stop offering a Game. Some updates may be required to keep playing. We do not guarantee that the Games will always be available, uninterrupted, free of errors or compatible with every device. If we stop offering a Game or feature you have paid for, we will give reasonable notice where the law requires it.

11. Suspension and termination

You can stop using the Games at any time by uninstalling them. We may suspend or end your access if you break these Terms, commit fraud, put other players or our services at risk, or if the law requires it. When your access ends, your licence ends too. Sections that by their nature should continue, such as intellectual property, disclaimers, limitation of liability and governing law, remain in effect.

12. Disclaimer

To the extent permitted by law, the Games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This does not affect any warranty or right that cannot be excluded under consumer law.

13. Limitation of liability

To the extent permitted by law, Hitmania Games is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, progress or Virtual Items, arising from your use of the Games. Our total liability to you for any claim relating to the Games is limited to the amount you paid for in-app purchases in the 12 months before the claim.

Nothing in these Terms limits our liability for intentional misconduct or gross negligence, for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited by law.

14. Indemnity

To the extent permitted by law, you agree to compensate Hitmania Games for claims, losses and expenses caused by your unlawful use of the Games, your serious breach of these Terms or your infringement of someone else’s rights. This section does not apply to consumers where consumer law does not allow it.

15. Games downloaded from the App Store

If you downloaded a Game from Apple’s App Store, the following also applies:

• These Terms are between you and Hitmania Games only, not Apple. Hitmania Games, not Apple, is solely responsible for the Game and its content.
• Your licence is limited to using the Game on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where supported.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Game, if any. To the extent permitted by law, Apple has no other warranty obligation for the Game.
• Hitmania Games, not Apple, is responsible for handling any claims relating to the Game, including product liability claims, claims that the Game does not meet legal or regulatory requirements, claims under consumer protection or privacy laws, and claims that the Game infringes someone else’s intellectual property.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must also follow any third-party terms that apply when you use the Game, such as your mobile data provider’s terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

16. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the “Last updated” date above. If the changes are significant, we will also tell you in the Games. If you keep playing after the changes take effect, you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law rules. Disputes will be resolved by the courts and enforcement offices of Istanbul.

If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may also bring a claim before its courts. Consumers in Türkiye may apply to consumer arbitration committees or consumer courts within the limits set by law.

18. General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right, that does not mean we have waived it. We may transfer our rights and obligations under these Terms to a company that takes over the Games; you may not transfer yours without our consent. These Terms, together with our Privacy Policy, are the entire agreement between you and Hitmania Games about the Games.
